My T&Cs
Below is a set of no-nonsense terms & conditions which is designed to make life easier for everybody involved. My T&Cs are designed to be a WIN-WIN, not an term-sealed entrapment. I believe in keeping things simple and communicating effectively – I realise that my T&Cs may not cover all eventualities and ambiguities, but by being 100% honest with my clients (and not using lawyer-speak) I expect the same level of honesty back in resolving any matter that may arise.
- Websites in 24 hours. This is not a contractual promise, but a fact. I can complete your website in this period of time, from the time I start working on it. Depending on my workload, you can expect your website to be up and running pretty soon. Bear in mind that a large percentage of website projects run for over 12 months, and nearly always beyond their schedule. I’ve worked in this industry for many years and I have first-hand experience of how a website can take at least 6 months to complete. I came to realise however that the real reason for this is simply working with an ineffective system and communicating poorly with the client.
- When is a website complete? A website is complete and billable when a website is complete – it’s that simple. As a website designer, my job is to create a working website for the client. I cannot create the content for the website – that’s the client’s job. My websites are all self-admin: this means that the website comes with a private area into which the client can log in and edit their own content. I like to give my clients an extra helping hand, and I offer 2 ways of doing this: my clients can either log in and edit their own content, or they can e-mail me their content and I will add it on for them, to get them up and running as fast as possible.
- When is a website billable? A website becomes billable when it’s complete and approved by the client. The content of the website is the client’s own responsibility (see point 2). The client has 2 weeks in which to approve the website, but it should take no longer than a short interaction with the website to decide upon its quality. I am flexible and understanding, and if a client approves a website and later discovers or realises that (s)he requires an addition or something similar, I will do this at no cost – within reason. I’ve never yet encountered an issue with this and I find that by adding this level of flexibility not to mention a relaxed approach) it works great for both me and the client. The client is under no pressure, and as genuine oversights do occur my main priority is to close the project cleanly and provide the client with a great website s(he) is happy with.
- Website downtime. Very few webhost providers claim 100% uptime, and those who do charge for the privilege of hosting on redundant servers (and such technologies). My websites are hosted on one of the most respected webhosting platforms on the planet, but in order to keep costs down (for both me AND the client) they don’t come with a 100% uptime promise. Having said this, webhosts work very hard at staying ‘up’ (on-line): it’s how they pay their bills. If an issue occurs, you can be sure there will be engineers working around the clock to solve it.
- Hacking. Hacking is a reality, unfortunately. There are hacking sites with counters showing how many websites are being hacked per minute, and the numbers are staggering. In the event of a website being hacked, the website will be restored from a backup and the issue investigated as best as possible. It is not always possible to keep skilled hackers away from a website, so please be realistic if this ever happens to your website. If Microsoft – the richest company on the planet – can’t keep hackers from finding and exploiting weaknesses in their software, then the rest of the software houses (including the ones that create and provide the software that websites run on) will surely have a tough job on their hands to do so.
- I reserve the right to terminate any agreement between me and the client should this be deemed necessary.
That’s it. Nice and simple. This seems like an appropriate place to add that:
- I’ve never had a client leave yet
- I’ve never had to terminate an agreement
I believe the above 2 points are largely due to:
- Working hard and providing quality products and services
- Using clear and efficient communication
Terms of Service
Whilst it is unfortunate to have things malfunction, we live in the ‘real’ world and things do go wrong. All systems, software and hardware, provided are intended to provide a solution to a task. However, no provision can be made to prepare for every eventuality.
Where appropriate, any system or procedure will be set up and tested and approved by the client before going ‘live’. In the event that said system or procedure malfunctions or does not continue to produce the required output, the system will be corrected (or there will be an attempt to correct the system) as soon as the error has been notified or discovered.
Where appropriate, if a system can’t be corrected, a replacement will be sought.
In particular, software can and often does malfunction. In the case of websites that use software components to add functionality (such as contact forms, any type of data capture mechanism etc) but that are not part of the core software of the website itself, software updates to the core files may in some cases disrupt other software components.
No responsibility can be taken for any software malfunctioning (especially for software is not developed by myself).
However, I will work to the best of my ability to correct any problems or issues such as the above.
